Terms of Service.

The rules of the road.

These Terms of Service ("Terms") govern your use of the Schaltworks website and the pay-per-lead service described below. By using the site or purchasing a batch, you agree to these Terms. If you do not agree, do not use the service.

1. Who We Are

Schaltworks is a Delaware limited liability company ("Schaltworks LLC"), founded and operated by Linus Michael.

2. What We Do

Schaltworks generates homeowner leads through paid advertising and delivers them to home service businesses ("Clients") who purchase a batch. Each batch is a fixed quantity of qualified leads for an agreed flat fee, paid upfront.

3. Eligibility

You must be at least 18 years old and authorized to enter into contracts on behalf of your business. Schaltworks reserves the right to refuse service to anyone.

4. The Batch Model

Purchase

A batch consists of a specified number of qualified leads (minimum 25) at a flat fee agreed on your strategy call. Payment is due in full before we begin ad campaigns.

Delivery

Leads are delivered in real time as they are generated. Delivery channel (email or CRM push) is agreed on the strategy call. Typical delivery pace is a portion of the batch per week, though it varies by trade, metro, and season. There is no guaranteed delivery date for an individual lead within a batch.

Lead Qualification

A "qualified" lead meets all of the following:

  • Located within the Client's agreed service area
  • Filled out the qualification form with project type, timeline, and contact details
  • Indicated a timeline of "ready now" or "1 to 3 months" (researchers are filtered out)
  • Contact details (phone and email) pass basic validation

Credits

If a delivered lead fails any of the above qualifications (e.g., wrong number that does not connect, outside service area, wrong trade, confirmed fake), Client may report it within 72 hours of delivery and Schaltworks will credit a replacement lead to the batch at no additional cost. Credit requests after 72 hours may not be honored.

Exclusivity

Every lead is exclusive to the Client who purchased the batch. Schaltworks will not deliver the same lead to any other business.

5. No Guarantee of Outcomes

Schaltworks delivers qualified leads. We do not guarantee that you will close any of them. Sales conversion is 100% the Client's responsibility. Lead quality and conversion rate depend on your trade, pricing, responsiveness, sales process, and market conditions.

5A. SMS Communications

Program description: Schaltworks operates a transactional SMS program for prospects who book a consultation call with us. By providing your phone number on our booking form and checking the SMS consent checkbox, you consent to receive SMS messages from Schaltworks related to your appointment. Message use cases include: appointment confirmations, appointment reminders sent 24 hours, 4 hours, and 1 hour before your scheduled call, and rescheduling communications.

Message frequency: Up to 4 SMS messages per scheduled call (1 confirmation plus up to 3 reminders).

Opt-out instructions: You can opt out at any time by replying STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT) to any Schaltworks SMS. Once you opt out, you will no longer receive SMS from us unless you explicitly re-subscribe.

Message and data rates: Standard message and data rates may apply per your mobile carrier. Schaltworks does not charge you for SMS; any charges come from your carrier based on your plan.

Carrier liability disclaimer: Mobile carriers are not liable for delayed or undelivered messages. Schaltworks is not responsible for any delays or failures caused by the carrier, your device, or network conditions outside our control.

Age restriction: You must be 18 years of age or older to consent to receive SMS messages from Schaltworks.

No sharing: Schaltworks does not sell, share, rent, or disclose your phone number or SMS opt-in data to any third parties for any purpose. Full data handling details in our Privacy Policy.

6. Payment and Refunds

All batches are prepaid in full. Once the campaign has been set up and lead generation has begun, batches are non-refundable. If the batch has not yet begun delivering at the time of your cancellation request, Schaltworks will refund the unused portion after deducting any setup costs already incurred.

7. Acceptable Use

You agree not to:

  • Resell, redistribute, or share delivered leads with any third party
  • Use leads for purposes other than contacting the homeowner about their stated project
  • Spam, harass, or deceive the homeowners whose leads we deliver
  • Violate any applicable law, including TCPA, CAN-SPAM, and state-level telemarketing rules
  • Attempt to reverse-engineer or scrape our funnel or systems

Violation may result in immediate termination of service without refund.

8. Intellectual Property

All website content, designs, copy, funnels, and materials are the property of Schaltworks. You may not copy, modify, or redistribute any of it without written permission. Delivered lead data belongs to the Client who purchased the batch, subject to the Acceptable Use rules above.

9. Confidentiality

Both parties agree to keep confidential any non-public information shared during the engagement, including pricing, campaign details, and lead data.

10. Limitation of Liability

To the maximum extent permitted by law, Schaltworks's total liability for any claim related to this service is limited to the amount paid by Client for the batch in question. Schaltworks is not liable for indirect, incidental, consequential, or punitive damages, including lost profits or missed business opportunities.

11. Warranty Disclaimer

The service is provided "as is" without warranties of any kind, express or implied. Schaltworks does not warrant that the service will be uninterrupted, error-free, or that any particular lead will convert.

12. Termination

Either party may stop doing business at any time. Schaltworks may suspend or terminate service for violations of these Terms, non-payment, or any conduct we reasonably determine to harm our business or other Clients.

13. Changes to the Service

Schaltworks may update the service, pricing, and these Terms at any time. Changes do not affect batches already paid for. Continued use of the site or purchase of a new batch after an update constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Any dispute will first be addressed in good-faith negotiation. Disputes that cannot be resolved are subject to the exclusive jurisdiction of the state and federal courts located in Delaware.
